Please read these Terms of Service carefully before booking our services. By completing your booking, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Services Overview

Red Trux provides professional family storytelling and recording services, including:

  • Family Storytelling Sessions: Audio and video recording, professional editing, and keepsake delivery

  • Seasonal Experiences: Immersive themed family recording sessions featuring special environments, projection mapping, and premium keepsake packages

  • Podcast Production: Professional podcast recording and ongoing production services

  • Custom Projects: Videography, branding, and other creative services as agreed upon

2. Booking and Payment

  • Advance Booking: Online booking through our website scheduling system is encouraged for all services and required for premium packages

  • Walk-In Availability: Basic and standard packages may be available for walk-in sessions, subject to studio availability and staff scheduling

  • Payment Required: Full payment is due before session begins (advance booking) or upon arrival (walk-in sessions)

  • Confirmation: Advance bookings receive email confirmation within 24 hours; walk-in availability confirmed upon arrival

  • Package Changes: Upgrades available until 48 hours before scheduled session or upon walk-in arrival; downgrades not permitted after booking confirmation

  • Walk-In Limitations: Walk-in sessions are first-come, first-served and may have limited package options or extended wait times

3. Cancellation and Rescheduling Policy

  • Advance Booking Cancellations: 48-hour advance notice required for standard sessions

    • 48+ hours: Full refund minus 10% processing fee

    • 24-48 hours: 50% refund

    • Less than 24 hours: No refund

  • Seasonal Experience Cancellations: Due to special setup and limited availability:

    • 3+ days: Full refund minus 15% processing fee

    • 24-72 hours: 50% refund

    • Less than 24 hours: No refund

  • Walk-In Sessions: No cancellation policy applies; payment due upon service completion

  • No-Shows: Advance bookings forfeit full session fee for no-shows

  • Rescheduling: One free reschedule with appropriate notice for advance bookings; additional reschedules subject to $50 fee

  • Weather/Emergency: We will work with you to reschedule due to severe weather or emergencies

4. Client Responsibilities

By booking our services, you agree to:

  • Arrive on time for scheduled sessions or be prepared to wait for walk-in availability

  • Bring any personal materials, songs, or stories you wish to include

  • Ensure all participants are comfortable with recording and understand the session format

  • Provide accurate contact information for delivery coordination

  • Follow studio safety guidelines and respect equipment

  • Supervise minors at all times during sessions

  • Walk-In Clients: Understand that service may not be immediately available and wait times may vary

  • Seasonal Experiences: Dress appropriately for themed photography; arrive 15 minutes early for setup briefing

5. Limitation of Liability

Maximum Liability: Red Trux's total liability for any claim shall not exceed the amount you paid for services.

Excluded Damages: Red Trux is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Lost profits or business opportunities

  • Emotional distress or sentimental value

  • Travel expenses or time lost

  • Costs of alternative services

  • Wait times for walk-in services

Technical Limitations: While we maintain professional backup systems, we are not liable for:

  • Equipment malfunctions beyond our reasonable control

  • Power outages or internet connectivity issues

  • Data corruption or loss due to technical failures

  • Delays due to circumstances beyond our control

Walk-In Service Limitations: Red Trux is not liable for:

  • Unavailability of walk-in services due to scheduling conflicts

  • Extended wait times for walk-in clients

  • Limited package options for walk-in sessions

Premises Liability: Clients participate at their own risk. Red Trux is not liable for injuries on premises except in cases of gross negligence.

6. Professional Service Disclaimers

Red Trux provides creative and technical services only. We explicitly DO NOT provide:

  • Therapeutic Services: Our sessions are for entertainment and keepsake purposes, not counseling or therapy

  • Legal Services: We do not provide legal advice, will preparation, or estate planning services

  • Medical Services: We are not healthcare providers and offer no medical or mental health services

  • Financial Planning: We do not provide investment, insurance, or financial planning advice

  • Professional Archival: While we provide secure storage, we are not legal document custodians

  • Guaranteed Outcomes: Results depend on participation and cannot be guaranteed

  • Guaranteed Availability: Walk-in services are subject to availability and not guaranteed

7. Seasonal and Themed Experience Terms

Availability: Seasonal experiences available based on studio setup and scheduling availability. Premium seasonal packages require advance booking.

Experience Elements:

  • Themed environments are weather and equipment dependent

  • Photo opportunities included but not guaranteed due to technical limitations

  • Props and costumes provided as available; personal items welcome

  • Sessions may be adjusted based on group size and age of participants

Delivery Timelines:

  • Entry-level packages: 3-5 business days delivery

  • Mid-tier packages: 5-7 business days delivery

  • Premium-tier packages: 7-10 business days delivery due to comprehensive editing

Seasonal Deadlines: For holiday delivery, final sessions must be completed by specified deadlines communicated at booking. Sessions after deadline dates will be delivered in January.

8. Intellectual Property and Usage Rights

  • Your Content: You retain all rights to your personal stories, songs, and family content

  • Our Production: Red Trux retains rights to production methods, editing techniques, and processes

  • Marketing Usage: We may use anonymous testimonials and general project descriptions for marketing unless you opt out

  • Copyright Compliance: You are responsible for ensuring rights to any copyrighted material you wish to record

  • Social Media: You may share your final products on social media; we appreciate tags (@redtruxwa)

9. Product Usage Rights & Restrictions

Personal Use Rights:

  • Family Use: Unlimited personal use by immediate family members and session participants

  • Personal Sharing: May share with extended family, friends, and on personal social media accounts

  • Personal Reproduction: May create reasonable copies for family members and backup purposes

  • Gift Use: May give copies as personal gifts to family members and close friends

Commercial Use Restrictions:

  • No Commercial Sale: Products may not be sold, licensed, or distributed for commercial purposes without written permission

  • No Public Performance: Products may not be used in commercial venues, broadcasts, or public performances without permission

  • No Commercial Derivatives: May not create commercial derivative works or remixes for sale or distribution

  • No Professional Use: Products may not be used in professional portfolios, marketing materials, or business contexts without permission

Platform and Sharing Guidelines:

  • Social Media: Personal sharing encouraged; please credit Red Trux when practical and tag @redtruxwa when possible

  • Personal Platforms: May upload to personal cloud storage and family-sharing platforms for private use

  • Public Platforms: No uploads to commercial file-sharing, streaming, or distribution platforms without permission

  • Attribution: Do not remove Red Trux branding or represent work as self-produced

10. Product Support & File Management

Technical Support:

  • Playback Support: Assistance with file playback issues and device compatibility questions

  • Format Assistance: Limited format conversion support if needed for compatibility

  • Support Availability: Technical support provided via email during regular business hours

  • Support Period: Technical support available for reasonable period following delivery

  • Response Time: Support inquiries answered within reasonable timeframe

File Management & Access:

  • Initial Access: Download links or access methods provided for reasonable period following delivery

  • File Storage: Digital files securely stored for duration specified in package terms

  • Re-Delivery: Files may be re-delivered upon reasonable request during storage period

  • Backup Recovery: Reasonable effort made to recover files from backups if client experiences total loss

  • Client Responsibility: Clients encouraged to create personal backups of important files

Ongoing Services (Where Applicable):

  • Anniversary Reminders: Annual reminder service for applicable packages, subject to current contact information

  • Service Updates: Clients responsible for maintaining current contact information for ongoing services

  • Opt-Out Options: May discontinue ongoing services at any time upon request

11. Returns, Exchanges & Satisfaction Policy

Digital Product Policy:

  • No Returns: Digital products cannot be returned once delivered due to their intangible nature

  • Quality Issues: Technical quality problems addressed through warranty and remedy process

  • Content Concerns: Dissatisfaction with personal content, family dynamics, or subjective preferences not grounds for return

  • Preview Options: Reasonable preview opportunities may be available before final delivery upon request

Physical Product Policy:

  • Return Period: Limited return period for unused physical items in original condition

  • Return Requirements: Items must be unopened and in original packaging for return eligibility

  • Return Costs: Client responsible for return shipping unless item was defective or incorrect

  • Restocking: Reasonable restocking fee may apply for returned items in good condition

  • Custom Items: Personalized or custom items cannot be returned unless defective

Exchange and Upgrade Options:

  • Package Upgrades: May upgrade to higher package tier within reasonable period for price difference

  • Format Changes: Limited format or delivery method changes available within reasonable timeframe

  • Defect Exchanges: Defective items exchanged for equivalent items

  • No Downgrades: Downgrades to lower-tier packages not available after delivery

  • Scope Limitation: Satisfaction commitment applies to production quality and service delivery, not personal content preferences

12. Delivery and Quality Standards

  • Professional Quality: We provide professionally-edited content meeting the quality standards detailed in our product specifications

  • Delivery Methods: Digital delivery via secure download link; physical items shipped to provided address

  • Revisions: Minor editing adjustments included as specified in your package

  • Format Standards: Products delivered in formats specified in package descriptions

  • Storage: Backup files maintained for duration specified in your package

13. Product Specifications & Deliverables

Digital Product Standards:

  • Audio Files: Clear, professionally-edited audio free from significant background noise and technical defects, delivered in industry-standard digital formats compatible with common devices and media players

  • Video Files: High-definition video recording with professional editing in widely-supported digital formats

  • Photo Files: High-resolution digital images suitable for personal printing and digital sharing

  • File Organization: All digital content clearly labeled and organized for easy identification

  • Delivery Method: Secure digital delivery with reasonable re-access period as specified in package

Physical Product Standards:

  • Storage Devices: Durable USB storage devices with adequate capacity for package contents, provided in protective packaging

  • Printed Materials: Professional-quality printing on premium paper stock appropriate for keepsake purposes

  • Packaging: Protective packaging appropriate for safe shipping and presentation, branded as available

  • Shipping: Reliable shipping method with tracking capability for items requiring delivery

Package-Specific Deliverables:

  • Entry-Level Packages: Core digital content, essential physical components, and basic printed materials as described in individual package details

  • Mid-Tier Packages: Enhanced digital content, upgraded physical components, additional printed materials, and select value-added services as specified in package descriptions

  • Premium-Tier Packages: Comprehensive digital content suite, premium physical presentation, extensive printed materials, enhanced services, and additional keepsake elements as detailed in individual package descriptions

Package Details: Specific deliverables, components, and services for each package tier are detailed in the individual package descriptions available at time of booking. Package contents may vary based on seasonal offerings and service availability.

Specification Flexibility: Red Trux reserves the right to substitute equivalent or superior materials, formats, or delivery methods while maintaining the quality standards and value proposition of each package tier.

 

14. Product Warranty & Quality Guarantee

Quality Standards:

  • Professional Standards: All products meet reasonable commercial standards for family keepsake and entertainment purposes

  • Technical Quality: Digital files tested for compatibility with standard consumer devices and software

  • Production Standards: Professional editing, noise reduction, and enhancement applied according to industry best practices

Defective Product Policy:

  • Digital File Issues: Files that are corrupted, unplayable, or significantly below stated quality standards will be corrected or re-delivered at no charge

  • Physical Product Defects: Items that are damaged, non-functional, or materially different from package description will be replaced

  • Shipping Issues: Items damaged during shipping will be replaced at no charge with reasonable proof of damage

  • Warranty Period: Quality issues covered for 90 days from delivery date

Quality Remedy Process:

  • Reporting: Quality concerns must be reported within warranty period via email with specific description of issue

  • Good Faith Resolution: Red Trux will work in good faith to resolve legitimate quality issues promptly

  • Remedy Options: Correction, re-delivery, replacement, or reasonable alternative remedy at Red Trux's discretion

  • Resolution Timeline: Quality issues addressed within reasonable timeframe based on complexity

Warranty Limitations:

  • Source Material Dependency: Final product quality cannot exceed the quality of source material recorded during session

  • Participation Dependency: Product quality depends on client participation and session cooperation

  • Normal Use: Physical products subject to normal wear and tear after delivery

  • Technology Evolution: Long-term compatibility with future devices or software not guaranteed

  • Subjective Preferences: Personal taste, family dynamics, or content preferences not covered under quality warranty

 

15. Privacy and Data Protection

  • Session Confidentiality: All personal stories and family information kept strictly confidential

  • Secure Storage: Client files stored on encrypted, secure systems

  • No Third-Party Sharing: Content never shared without explicit written consent

  • Data Retention: Personal information retained only as long as necessary for service delivery

  • Right to Deletion: You may request deletion of personal data subject to legal retention requirements

16. Force Majeure

Red Trux is not liable for delays or inability to perform due to circumstances beyond reasonable control, including: natural disasters, government restrictions, equipment failures, illness, pandemic restrictions, or other unforeseeable events. We will reschedule when possible or provide appropriate remedies at our discretion.

17. Dispute Resolution and Legal Terms

  • Governing Law: These terms are governed by Washington State law

  • Jurisdiction: Disputes resolved in Snohomish County, Washington courts

  • Mediation First: Parties agree to attempt mediation before legal action

  • Severability: If any provision is unenforceable, remaining terms stay in effect

  • Entire Agreement: These terms and your package description constitute the complete agreement

Advance booking confirmation emails serve as electronic acceptance of these terms. Walk-in clients accept these terms by proceeding with services.
